Open Question: A/C is broke in rental apt with 2 infants it is 88 degrees should management pay for hotel?

My a/c has been broke since yesterday. Horrible timing as it is 97 degrees outside. The worse part is it is literally 88 degrees in here (thermostat says so and it feels even hotter). We are renting an apartment so all maintence is done through management. i called yesterday and got no answer. Since it was after hours i had to wait until this morning to call again. This time i called the emergency maintence number. Got no answer, a guy called back later and i told him my a/c hasn't been working since yesterday its 88 degrees. Can someone be sent over asap. He said someone would be by today. Its now 5 hours later and haven't heard anything. We have a 1 yr old with asthma and a 2 month old. We have no family or friends to stay with. I'm sure it will take time fixing and need parts and its unbareable to sit here and wait. However money is tight and we really can't afford a hotel. Should management be responsible for paying for a hotel since they have failed to fix it more

Voting Question: Anyone know Va State Law for notification before entering rental property?

On my lease it states : Lessor may enter residence at any reasonable time to inspect, repair and maintain it or to show the property to prospective purchaser, lender or insurance agent or to show the premises to prospective resident. I signed this lease but NOT before informing them that I work night shifts and I asked that they notify me before they enter. Well they entered numerous times and eventually I had to print a sign stating : Night shift employee, Please Do Not Enter!. The other day I woke to FOUR people standing in my apt while I slept. I told them to get out and the woman showing them did not leave. I called the leasing office and left a heated voicemail and confronted the woman. She stated she saw the sign but absolutely had to show the apt. The two other women who tried before to show the apt kindly left AND there are two empty apartments beside me they could have shown. This is unacceptable to me. It is incredibly hard for me to fall back asleep and when working 12 hours shifts I need sleep. I need help finding a law or something of that nature stating that proper notice must be given before entering any rental property. Does anyone know this?? more

When I questioned the assiocation manager and apt manager about getting a dog, they advise that agreesive breeds are banned from premises including pittbulls. New maintance guy hired by developer in last month, after hours mainly around night time seen walking a pittbull and the pittbull has been aggressive towards people and dogs. He also has been placing dog in tennis court/basketball courts and letting dog run around with the fence and in the bylaws stating it is off limits for animals to be in there. What can I do about this problem? I was forced to have roommate get rid of their pittbull mix before moving in due to this bylaw. more

Voting Question: can a tenant withhold rent?

Is it legal for a tenant to withhold rent in PA? There is nothing wrong with the apartment. They are always going on about it being unliveable. They claim their lawyer told them that. I don't understand how. Since they moved in 6 months ago I have had more issues with this apartment than i ever had. The 3 big things are. 1: the roof was leaking we found where a seal wasn't completely sealed so we fixed it. There have been no more complaints. 2: they got shocked when touching a radiator. We had an electrician come in right away something was touching the radiator he fixed it and there have been no more complaints. The only thing that has not been fixed is #3 the kitchen sink needs replaced. However, I purchased a sink and new counter for the kitchen however they don't want it bc I did not let them pick it (which there was never any agreement for them to choose it). and they want something other than what I bought (and wayyyyy too pricey to put in a rental). They have had various other complaints. 1: they smelled (what they claim was) crack from another unit. The neighbor let us in and his apartment did not smell at all. My husband checked the complainants unit and all he smelled was nail polish remover in the 4 yr old daughters room when we suggested perhaps she got into something they bcame irate but we smelled nothing no where on the property 2: after a rain the 4 yo daughter bedroom was flooded. When we went in there was some water on the floor. We checked the walls and window and there was no trace of water. It wasn't the roof bc my mother lives in the apartment above them and a bedroom is over the daughter's bedroom. I went into my mothers apt and checked the bedroom it wasn't wet and there was no traces of anything leaking and nothing had been spilled. There is always something. But the only issue that wasn't dealt with is the kitchen sink (this ordeal happened about 2 wks ago). I have decided to set up the replacement with what I purchased and give them notice. If they refuse to allow a service person in it is against their lease. But can they withhold rent bc I did not buy what they wanted? Or, bc I put off the replacement of the sink bc of their refusal to allow me to put in what I bought?There were never any agreements made such as no rent being paid for them not getting to choose replacement items. I have suggested they live elsewhere. And have worked an agreement where they do not pay any penalties for breaking they lease htey just will not leave (I think they are having difficulty finding a place bc they want something that makes it look like they have more money than they actually do. They lease everything through buy here pay here places and are in terrible debt bc they own nothing and rent everything which I did not know until after they moved in all their checks came back good)To clarify I was never going to purchase or install the sink they wanted. When I said about scheduling the installation I meant for the one I already purchased. I just wanted some unbiased opinions of the situation to see if perhaps I had missed something more

They have little life insurance only through employers, about $100,000 each. The husband is planning on using some of the funds to improve his schooling and earning or take a new career. Perhaps computer networking, web design or a short training in health field such as ultrasound or mri tech. They have $900 in savings. They have one child, no pre-pay college yet, child is 2 years. My boyfriend and I moved in together in October of 2009. I was laid off from my job early Jan of 2010 and began to struggle with paying rent. Our rent is $720.00 and we were splitting it directly down the middle meaning that we would both be paying $360.00 each. My boyfriend was working and I was recieving unemployment [$287.00 a week] and again, with all of my other bills such as car pymnt, car ins, electric, renters ins, food, etc... it was a bit hard to keep up with rent, but it was always paid. My boyfriend of 7 yrs met another girl and decided to move out in April of 2010, but agreed to continue to pay his half of the rent. Meanwhile, i'm still out of a job [looking for employment] and still trying to pay not only my half of the rent... but all of the bills that my ex left behind [that we were once splitting]. As of July 2010, my unemployment benefits ran out [with no option to apply for a extension] and my ex boyfriend has now refused to continue paying his half of the rent, but our lease is not up until October 11th, 2010 [BOTH of our names are on the lease]. It is now August, and I have just recently been offered a new job that is 1 hour and 45 minutes [is about 74 miles] away from my current apartment. [I have a family memeber that I can live with in that area, it is a great job & I can't afford to pass it up.] I absoloutley cannot afford to continue to pay my half of the rent & his. I studied my lease and I have found a section where it says WORD FOR WORD ------"Release Of Resident. Unless you're entitled to terminate this Rental Agreement, you won't be released from this Rental Agreement. Written notice delivered 60 days prior to the expiration of the rental agreement is required. You MAY terminate this lease within 30 days: (1) due to a documented change in employment to a location more than 30 miles away; (2) due to serious illness suffered by you or a memeber of your immediate family requiring a permenant change of residence; (3) if you are accepted for admission into a senior citizen housing facility; (4) if your surviving spouse or personal representative of your estate elects to do so."------ Now, with this being said... I have gone to my rental office and informed them of neccesary information that I felt they needed to know. They were already aware that my ex no longer physically lived in the apt, and I informed them that I was not working [I have unemployment slips to prove it] and I also informed of my new job [I have a offer letter to prove it]. The leasing consultant in my rental office looked me in my face and said ------"Oh. well, that doesn't matter... it has to be a job that you already had in the 1st place. Meaning, it has to be a job transfer from your current employer."------ But my lease DOES NOT state that the offer must be from a job that I am already currently working, it says ---"You MAY terminate this lease within 30 days: (1) due to a documented change in employment to a location more than 30 miles away;"--- I asked to speak with the property manager & the leasing consultant said that she would have the property manager call me. DOES ANYONE KNOW IF I CAN FIGHT THIS? I need this job and I cannot afford to live in this apartment on one income. What can I do???? HELP PLEASE! more

Voting Question: How can a landlord advertise amenities we do not have such as fitness rooms?

We have not had a fitness room for 6 years, I believe. They promise. It is run by Morgan Properties in PG County. The only recourse so far, unless you are a lawyer, is the Atty Gen. Office. They have no legal jurisdiction. They make an apt. for a conference. Meanwhile, I could not go to the apt, the Atty Gen office was supposed to change the date....NOT A WORD. Taxation without representation. Selectivity of laws. Yes, tenants have rights, but we need an agency that can legally represent us in a court of law. By the way, one of my leases said I could not have a jury trial in the event of a lawsuit. They have had a few, including towing cars illegally from our parking lot. I just paid my rent. Saw the amenities. We are also paying Ratio Utility Billing and BGE. The RUBS goes to a company in CA. The lease states it is not a utility company. In essence, we are paying twice for electricity. Meanwhile, I read the website for my apartment community. 1) Our apt door is NOT secured 2) no fitness rooms 3) I have an old lease, never negated...btw they illegally took away my storage bin without notice. I did have a lawyer, although I did all the work. However, he changed his mind. His buddy works for my apartment. 4) They cannot keep their accounting correct. I'm tired. I have pages and pages of evidence against this company and apartment community. In fact, in 2007, a congressman called them and told them Rubs could not be added to my lease. They are informing new tenants that it was instituted in 2010, a lie. Some tenants were able to go to court and are not paying the RUBS, which amounts to $65 for 2 bedrooms no matter how many people live there. The $5 is for trash. Don't you think $1215 is enough to cover water, sewage, trash, heat, and a/c. BTW, the web-site says that some utilities are paid. I would love an answer to that one. Heat and a/c are controlled by BG&E. BTW, the water company was of no help. The average electric is $65 after the state of MD deregulated it; it was about $25 a mo. before. We have NO METERS. The meter for BGE is in another building. I pay for a legal group but they are useless. Talked to fellow tenants about a lawsuit together. He has legal background. Tired of their lies. In the end, I know people lost their homes, how about all the evictions from apartments and rentals? Our landlords are gouging us. People are being evicted that have 2 tenants working good jobs. They can't even put a simple key guard on the lock. The lobby door was out of order for at least 3 years. I added a latch. Do not rent in PG county unless the complex has a very good rating and includes all utilities past and present. I know that some tenants are not paying the RUBS. They are not paying higher rents. I sign a new lease, I'm a new tenant. Love to hear some feedback. more

Hi. I live in Texas and I rent a 1br apt. I was late with the rent last month and I was sent eviction papers by the sherriff. Well, as an agreement, I paid off the rent plus and extra $400 in late fees to keep my apartment and to stay. Now, its going into August and I don't get paid until the 8th, so I won't be able to pay the rent until the 8th again. What will happen if I pay late again on the 8th. The grace period is until the 3rd of each month. I'm from MI and the laws are much different in TX as far as eviction laws. I'm afraid they won't accept my late rent this time. In my rental agreement, it said that if you are late after the 3rd, you will pay a $50 late fee, UNLESS you were served an eviction notice the month before....so I don't know what that means. ok. so my son is 2 1/2 years old. happy, hyper little boy. we just moved a couple months ago to another apt in the same complex. well the neighbors below us is a handicap old lady that has always been rude to us, ALWAYS. then there is her daughter, her daughters husband/bf/baby daddy(?) and son, plus random people in and out all the time. we have no issues with anyone else in the apartment but the handicap woman. she uses a can and also her electric wheelchair sometimes and uses an air tank. we hear her yelling ALL THE TIME. so my son, being a 2 1/5 year old gets excited and runs around and stomps, when he gets mad/frustrated/throws a tantrum he will kick/stomp/hit/scratch... he stomps more b/c he knows it will get a rise out of us. so when he makes any noise she uses her cane and bangs on her ceiling/our floor. so then he thinks its a game and stomps back. she is the only one in the apartment with an issue btw. so on 4th of july we got back from DC around 11pm, we were in the door for 5 minutes. i got in the shower, i tried to get my son to come in with me(he normally LOVES baths and showers) but he threw a tantrum, so i had my bf come in and get him out of the bathroom to calm him down. the woman (some how quickly being that she is handicap) came up the stairs within the 5 minutes of us being in the door, starting banging our door with her cane, my bf answered and she yelled at him that she was going to call the cops if we didnt keep him quiet. now i get home late from work bc i normally close at starbucks. so i get home around 9:30-11pm depending on when i get out of work. my son gets excited bc im finally home, so i starts running everywhere and wont go to bed without a fight. so i have 2 options, let him stay up till he eventually passes out and try to keep him happy by giving him whatever he wants so he doesnt throw a tantrum. or i can try to get him to bed early and then hes gonna throw a tantrum and stomp and scream. so tonight my son was a little excited, wasnt even as noisy as he usually is. there was a heat and air quality advisory so he didnt get to go play outside all day. i get an officer at my door tonight around midnight bc she called crying and complaining about my son being too loud. he didnt even want to hear me explain anything, he just said he will fine us $500 if he keeps having to come out. My boyfriend and I rent. It is a house, not a building or a complex, and it's separated into two apartments. Our friend rents the other apt within the house. We've had a good relationship with our landlord, she's nice and have never had any issues, we always pay on time, etc. We're in our second year of renting and we have a very small front yard. Our lease states that snow removal is our responsibility and lawn maintenance in the responsibility of our landlord. This spring/summer we had to remind our landlord several times that our grass needed to be cut, we only reminded her when it was really out of control or we were expecting guests. Otherwise, we figured it was on her radar. At first she did it, and now she pays a neighbor to do it since our lawn is so small and he maintains the rental property next to ours. Last year our little lawn looked fine but this summer it's totally fried out from the intense heat and what is left is a lot of weeds and patches of dirt. Some of the weeds are getting out of control. They've started to grow up between the sidewalk leading up to our home and it just looks pretty bad. Normally, I wouldn't mind weeding or doing what I could but we all commute quite a distance to our jobs and by the time I get home in the evening it's the last thing I want to do. Honestly, the reason we rent is so we wouldn't have to handle some of this stuff. I want a good relationship with our landlord, and I feel bad pestering her about our yard but it didn't look at all like this when we moved in, or even when we resigned our lease. I know she can't help the heat, but the weeds, and patches of dirt in the lawn are pretty bad. Would I be better off just trying to take care of it myself or should I keep asking? Maybe there is an arrangement she set up with the neighbor that he's not holding up and she's not aware? So check it its like this. About 3 weeks ago I notice that my change tin can isnt where it usually is. I thought nothing of it because I probably placed it somewhere else for one reason or another. When we rented our 3 bedroom apt, the tenant indicated it would be themself, a nanny, and 2 infant children, (and that a parent would be staying for the first month after the children were born). The rent includes all utilities. Over the course of the last year, the tenant's parents have stayed approximately 2 weeks of each month and we have seen them bringing their laundry and doing it while they are here, instead of their own home. Again, we are paying the utilities - and lowered the price of the rent because the tenant wanted to clean and paint themself when they moved in. Now, the one year mark is coming and we need some advice as to how to handle this situation. I think we should raise the rent and/or charge a surcharge for when the parents are here. I have a fire inspection sometime this week, and we're not supposed to have pets. I'm hoping they'll come when he's sleeping, but if it's not, I plan to hold him under a blanket and pet him until they leave (it's worked before with another cat) and have my TV loud so I can blame his quiet meowing on the TV. Its a complete shock & news to us cuz we thought we all got along great! We cant help but feel that they might have an issue with our lifestyle tho due to prior conversations about it, the guy is in the military, & military guys r over literally every week. Also, this is our 2nd month paying for rent here & residing in this Apt. The rent, & reason we moved in, was $450 a month including all utilities, which was paid, then around the middle of May they raised the rent to $550. What were we supposed to do... Leave after just moving in? There isnt a signed contract/lease, it was all verbal agreement (which is enforced in CA) & also agreed that we would be staying til Oct. So can they do this legally? Is there anything we can do etc? Additional questions: So would we have to be out by the end of the month even though we already payed for this month or would it be 30 days AFTER the month we paid for? Also, if we have to be out at the end of this month, would we be allowed money back if we were out before the end of this month since we wouldnt be here the full month? more

Voting Question: How to break a rental agreement (with low risks) from a Apt complex in California?

We have been living in a apartment complex in California for almost a year. We initially signed a 1 year agreement and it will expire September 1, 2010. When we were in our 6th month (around March of 2010), our apt mangers asked us to renew our lease. They gave us small initiatives if we did sign. We could had waited for our lease to end but they told us that our rent would be alot higher. So did end up signing for a year extension beginning September of 2010 Our family now has a problem that we won't be able to afford the new lease we signed to that will start in Sept of 2010 and that we are likely going to have to move out. Our contract said that they could pursue the entire amount of the lease (it is up to them if they want to). Our apt managers are bunch of jerks and I feel that our family is stuck and will soon encounter major problems. Can anyone offer any helpful advice? My fiance and I are moving to henderson, NV a suburb of Vegas so I can start grad school, I start the first of July. we are looking to buy a home but most of the places are short sales which I have heard take forever. I must have a house by July 1 or I am homeless so my question is how long do short sales really take and anyone out there with experience know if most sellers out there would give the buyer the option to rent the house until closing finally goes through. We rented a place in FL where the lease was to expire May 31st 2010. The landlord had previously asked if there was a way we could vacate earlier which I was happy with because I wanted to do the same also because the timing would have been better to move into a new place. We agreed on the 10th of May with the rent to be pro-rated, and we were out of the apt completely on the 9th. It has now been 18 days without any clear explanation as to why we have not received the refund. All we got out of the landlord was "will execute right after month end when your lease officially ends." I have looked at 3 or 4 law websites concerning Florida rental law and al seem to state 15 days (or 30 days if the landlord is going to impose any fines with an explanation). The rental has been occupied since May 15th by new tenants. Should i be taking further steps toward collecting or should I further bother the Landlord and if i get no explanation consider taking further steps? I was living in Toronto and rent an apartment in Sep.2009,the agreement was 1 year fixed.However,i had to leave Canada in Jan. 2010 due to family emergency,obviously i had to move out early which means break the contract,i told landlord the truth and tried to explained my difficult situation also showing the effort to find other tenants to fill in the vacancy,i did find people who were willing to take the apt. but the landlord wouldn't take my name off the lease and the person who moved in must be under my contract,so i told to her that i cannot take the risk to let someone under my lease since i had no power to conduct the credit check and not knowing one of them...so i called the rental board for advice,they said i had the right not to sub-lease,negotiated a new assignment with landlord,if not success i can file a letter to terminate the lease myself.I tried to negotiate but the landlord's company had no longer answer my phone..in the end,i mailed a letter to the company with detailed explaination,potential tenants' phone number and our email copy to show my effort also i paid that month's rent and left last month deposit for penalty, and i left with my furniture in the apartment and no damage,i cleaned the apartment. My question is did i breach the agreement and when i go back to Toronto,will that be difficult to rend an apartmetn again? how do i know the landlord take my case to the court or not?Thank you very much! more
