I have a home in CO. Our current tenants are moving out. Their lease ends Sept 30, but they are physically leaving Sept 15. I have already found a new tenant, and I have a couple of questions: 1. When do I collect deposit and first month's rent from new tenants if they are moving in Oct 1st? I want to collect it all now with lease signing, but property manager is saying she usually collects deposit now, and first month's rent when they move in on Oct 1st. I am worried about them changing their mind and not moving in. How far in advance of move in date should I collect first month's rent? 2. If new tenants want to move in before Oct 1, can I let them move in Sept 20? Would I have to reimburse old tenants for those 10 days, or do I not have to because old tenants moving out early is their choice? I don't want to double collect if I'm not allowed to, but I don't know the law for Colorado. My lease states that for occupancy purposes, one day constitutes a full month's rental. And my lease is a lease for term (it was a specific 3 month rental). My new tenants pay a higher rent, but after deducting property management fees, I actually get less than old tenants paid. A uhaul truck smashed into my parked car at a local storage facility(private property), and the driver did not stop. Luckily the event was captured on camera. Someone Rear Ended me on the 22nd I have injuries lost time at work a totaled car completely destroyed and I cant rent the insurance pays for rental but the difference I have to pay myself so no relieve I cant afford it. Ok so my question is completely hypothetical right now and is very distant and forward thinking. Quick just to give you some background, I am an officer in the U.S. army so i dont make the greatest income but it is roughly 32k annually and I have begun to save up a nice bit over time. So my question is would it be more lucrative for me, long term, to begin getting into the rental property business. Or simply put my money away into ETF's, aggressive mutual funds and other equity investments such as those? I am extremely interested in the real estate avenue and would prefer pursuing that route, I just am limited in my knowledge of what all goes into buying multiple homes, not all at once of course, all the hidden expenses, and how much work actually goes into it and how profitable it can be... My plan would be to hire a property management agency simply because my work, the army, will not allow me the proximity to the homes I would own to deal with immediate problems. In addition if I get deployed which is very likely obviously worrying about how my tenants are doing will be the last thing on my mind. So to reiterate, understanding my circumstances would "you" advise me to go the aggressive route and start trying to build up my assets in real estate/rental properties or would my money be better spent in equities and investments that I could just let sit( with a financial advisor) and hope for an 8% to 10% return annually. also I am very young, 23, single no dependents. I would love to buy rental properties however my personal cash has been more or less tapped out with the falling equity in my house. Therefore I need to use other peoples money however I don't know the best way to "ask" them for it and of course I am a little afraid of the "what if's" of the whole situation and losing their money. Is it best to offer a nice rate of return on their money for the short term or offer them equity in the property - more like a partnership. Hi all, I am currently looking to buy a new condo, new construction (9 unit complex). So far 2 properties have sold, however financing is difficult to get given it has not reached the required Fannie Mae occupancy levels. The condo has been on the market for 3 months now. The kicker is that the builder apparently has decided to start renting out a "few" of the properties instead of selling them. How should I think about this decision to rent out some of the units here? How would it affect the value of my condo unit?To clarify, the bank who did the construction loan (a reputable bank) is offering buyer financing. Landlord-tenant dispute - Commonwealth of Virginia I signed a lease for a rental property. Contained within the lease was a clause that allowed me to move and store my items in the basement area on 7/26/2010 while the "turn" was being performed on the upstairs portion with actual physical move-in date of 8/4/2010. The property management company did not communicate the clause to their cleaning crew and all of my items were removed from the property and placed in storage. When I learned of this removal I demanded that they return the property, which they did minus some valuable items, including: 2 motorcycle jackets, approx. $50 in change, 2 wristwatches, several football cards, a cell phone, and an MP3 player. The nature in which these items "disappeared" from the moving boxes, obviously speaks to theft (all of the silver change was taken leaving only pennies, a new watch was removed from it's watch box within moving box, the football cards were taken out of a small cash box packed in a moving box). I requested that these items be returned and no further legal action would be pursued. The cleaning crew and the property manager came out on 8/7/2010 to help "locate" the items, which was a pointless effort as I knew the items were not returned and would not be found among my other property returned from the storage units. Of course, they were unable to locate the items. The cleaning crew swears that they did not take the items. I filed a police report for the theft of the items on 8/7/2010. While I did have a renter's insurance policy in effect, I do not feel that I should have to lose the value of the deductible, require my insurance company to pay for items, and pay a premium increase, for items that were stolen as the result of the property management company's incompetence. So the next course of action is to initiate a lawsuit against the property management company for the value of the missing/stolen items. What on what grounds should I pursue a civil lawsuit? Negligence? Also, if I were to hire an attorney, could I sue the property management company to recoup his fees? Any advice or assistance is greatly appreciated. If you happen to be an attorney in the Blacksburg, VA area and are interested in representing my interests in this case, please let me know.The does state that they are "not responsible for stored items". She said to rent one of the homes, all i needed was to prove that i make twice the rental amount and i would need no money down, no credit check! How can this be, i asked! I was going to rent a house in march.. I gave a deposit and told them I was going to give the first month rent when I officially move in because the house was not ready yet, they were doing some major repairs, we didn't do a contract but he did gave me receipt. Then the morning came she never called I had to call her she said she spoke to him and said he spend the money on the house, and to deal with him, I told her she is the owner and I think she is responsible for that ever is done to that house, she said she will tell him to call me. He called and said he can't return the money. I told him first of all we never did a contract, I never moved in the place and why should I pay repairs or construction work that I will not be using. So at the end he said he was going to return the money back.. Ever since then he made excuse after another excuse. In other words he was decided not to pay. I told my husband to call him, he called him as well he kept giving excuses to him too till one day he disconnected his cellphone. Lucky I remember that day I spoke to the owner she told me she has a store and told me the location.. I went there to ask for her got in contact with her again, she said she has nothing to do with that money she said "they had deported the manager". I am thinking to of taking this matter to small claims court but can I sue her because she is the owner of the property because the manager is no where to be found. Before my husband and I even signed the original lease had they begun lying to us as tenants as the unit we looked at had a few "issues" we were told would be fixed prior to moving in such as needing wall repair in the bathroom and removal of garbage left behind by a prior tenant. Well moving day came along and low and behold when we got the keys not only was the unit which was supposed to be cleaned as promised had not had this done as there was dirty floors and dead bugs on the carpets as well as garbage in closets and a large work desk in the basement that my husband had to dismantle and remove in pieces. The house had an "off" smell and mould on the ceiling in the bathroom that despite scrubbing on a weekly basis never truly went away. The light switches were missing the plates in a couple of spots and there were missing floor vents (furnace)in two of the bedrooms. One of the lights in the basement did not work as well as the wall in the bathroom still had not been painted (eventually did this myself in the late fall of 2009 ) nor the broken door replaced (this was eventually done however, it was still unpainted when we left in 2010) and to top it all off in the time we lived there we had two major problems with the structure. The first one happened in February of 2009 when ice build up in the winter caused the roof to leak and caused water damage to the drywall in the master bedroom, something that despite writing up two work orders was still unfixed at the time we ended our tenancy in March of 2010, in fact we had to contact the property management company's head office before we even got the snow removed from the roof to prevent a leak that needed to have two large bath towels used every 1/2 an hour to clean up from continuing to soak the wall, carpet etc. Eventually the roof was "patched" (new shingles over the part where the leak occurred in the roof) in the spring however, the original shingles which were the same age as the house which was built in the 1970's were never replaced. The second was the main transformer for the fuse box in the house going which was fixed immediately but, I fear that was only due to the fact this happened after Nov. 1st and there is a rule about heat and hydro in the Landlord and Tenants Act along with the fact I had a small infant were the factors here. Lastly they are not very timely with their paperwork when raising your rent as you MUST get 90 days notice before an increase when your lease it up for renewal in our experience the lease expired the end of October however, the paperwork we received was dated the end of June and it was not physically delivered to us at our unit until the end of August well under the guidelines despite having a rental office and staff on site. There was also an issue when they showed up two days late to fix/test the furnace for the season without 24hrs notice and I had little but, no choice other than to let them as it was mandatory and I didn't want to run the risk of no heat. So therefore when we got the house immediately the next day after the paperwork had been finalized with the lawyer and the move in/out date arranged we sent a letter to the property manager's office explaining the situation EXACTLY as it had occurred at giving them over two months notice when requesting to be released from our lease, which we thought wrongly that in doing so they might allow since we had been good tenants who always paid our rent on time who kept our unit spotlessly clean, didn't throw wild parties or disrupt the enjoyment of other tenants and didn't have any "eyesores" garbage etc. out front or back, got along well with our neighbours and weren't just abandoning the unit BOY WAS I WRONG! The reason being that despite our reputation as tenants we still got dumped on for by noon that same day January 22, 2010 and without even coming down to our unit to discuss the situation and try and work out a solution we received a rather offensively worded letter that stated the following points: -You have signed another full year lease term. You signed August 30, 2009. The term of your lease expires on October 31, 2010, which you will be held responsible until that date or until we rent your unit. You are welcome to physically vacate anytime you wish, but you wil be held responsible for the rent until October 31,2010. Recently as my husband has learned upon contacting the office that the unit has been rented for September and that our rent which we paid for August will be returned to us however, there will be a $200 fee. I have looked thru my copy of the original lease and cannot find anything about a "fee" for breaking the lease early only that you would have to pay for the remainder which we have done. I also cannot find anything to state if this is indeed legal in OntarioAccording to the landlord the $200.00 is for a "Lease Fee" not anything to do with advertising or maintenance. The Landlord and Tenant Board of Ontario once again has proven usless as they did with all intital issues when they occurred. If we could have left earlier we would have unfortunately there was no other housing in our budget available at the time and they would have charged us regardless of when we left. Just grateful it's over.Also important to note we probably would have stayed on and continued to be tenants until the end of the renewed lease if it weren't for an unfortunate event in my family that resulted in the inheritance of our current house. I was recently evicted from a rental house almost a month ago, the landlord now has someone living in the home and my personal belongings are still in the house. When i say personal belongings i mean ss cards, past tax documents, prescription medications etc. I have a very small car and when the constable came i couldn't fit much in there to take with me. I am just wondering if this is legal or not, and i am VERY worried about my things still being there when i go to pick it up.I was served a 24 hour notice to leave before the constable came. I have a rental property. The people were always late paying rent or even didn't pay at all a few months ( I put them on payment plans to catch up and they failed at that, etc..) They may not have paid on time, but they made an effort to pay weekly and at least it was some income coming in. My fiance wanted his sister to move in there and said he would help pay for it until I got them evicted and her moved in. Well, I gave them eviction papers and guess what, he hasn't made any effort to help pay for the rental mortgage until his sister moves in and they are out (you know the current tenants will not pay a dime now that I am evicting them.) Anyhow, yesterday he said he wanted to go inspect the place and take pictures to see if there is any damage (the tenants have not moved out yet and I am going to have to take them to court). He called and gave them notice he was going, then he fell asleep and didn't. I told them he would be there today. I reminded him he is supposed to go there today and his response is "Why don't you go?" I am so frustrated with the whole thing. My aunt is really going through a hard time. Her son was arrested a few months ago on drug abuse charges (he's only 18, he was arrested at 17), and he has been pressed with drug charges and breaking and entering before. He will be in prison for up to 15 years, a minimum of 3 if he behaves. On top of this, her ex-husband is an addict and he's been in and out of rehab for a long time. He ruined quite a bit of her property (he crashed into her car and her rental car, for instance, and now she can barely pay the insurance.) Now he's been put in a mental institution. They never had much money to begin with. After I heard about her husband being put in a mental institution, I decided to try to cheer her up with a letter from here (she lives in another state.)
